Gloriscope.com website and service is published and 100% owned by 4T4C News Corp, an independent Christian publishing company based in Minneapolis-St. Paul in the State of Minnesota, U.S.A.

A. GENERAL
A1. DEFINITIONS
– “4T4C” or “we” or “us” or “our” shall hereinafter refer to 4T4C News Corp, which owns and operates Gloriscope.com.
– The “Site” shall hereinafter refer to the online site located on the World Wide Web at http://www.gloriscope.com or http://gloriscope.com
– The “Service” shall hereinafter mean all areas and all content, services or products available or offered on, or through, the above-defined Site. The Service includes, but is not limited to, our email newsletters (if any), RSS feeds (if any), email notifications, blogs (if any), etc.
– The words “User,” “you” or “your” shalll hereinafter refer to each person who establishes a connection for access to or use of the Service. without regard to the manner, frequency, location or platform of establishing such connection and without regard to whether the User (you) is a registered or unregistered user of this Site/Service.
– A “Member” shall hereinafter refer to a User with a Membership Agreement with the Service. Collectively, Members are a subset of Users in this Service: All Members are Users, but not all Users are Members.
– “United States” and “U.S.” shall hereinafter refer to the United States of America and all its territories.
A2. YOUR CONSENT TO THESE TERMS
Please read carefully through these Terms of Service (the “Terms”). By accessing and using this Service in any way, you agree to be bound by all of the terms and conditions of these Terms, without limitation or modifications.
If you do not consent to these Terms of Service and do not wish to be bound by them, or if you are not authorized to consent to them, you should immediately cease all usage of the Gloriscope.com Site and Service and exit Gloriscope.com. If at any later time you do not consent to these Terms, you should cease using Gloriscope.com and this Service and you should cancel your Membership or Subscription that you may have regarding this Service. By accessing and using Gloriscope.com or by otherwise using the Service, you warrant and represent that, (a) you are of legal age to use this Site and this Service and to create binding legal obligations for any liability you may incur as a result of the use of the Site.and this Service; (b) you have read, understood, and accepted these Terms and our Privacy Policy Statement (which is an integral part of these Terms of Service), (c) you are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. If you cannot warrant and represent (a), (b) and (c) in the foregoing sentence, please discontinue using this Service immediately and exit Gloriscope.com.
These Terms are a legally binding agreement (the “Agreement”) between you (the User) and 4T4C News Corp. regarding the use of this Site and this Service. The Agreement is legally binding (a) irrespective of the manner of accessing the Site (whether automated or otherwise), (b) irrespective of how Gloriscope.com content is delivered to you (via Web browser, WAP browser, SMS, email, or otherwise), (c) irrespective of the delivery platform you use - a desktop, laptop, PDA, cell phone, or any other platform available now or in the future.
We reserve the right to change, add or delete portions of the Terms at any time and from time to time. If the Terms are revised, we will notify you by email and/or post on Gloriscope.com a revised version of the entire Terms, indicating the date of the latest revision. A revised version of the Terms shall be effective immediately when posted on this Site. By continuing to use this Service, you agree to be bound by the revised Terms. You agree to review the Terms periodically to be aware of such revisions.
We also advise you that certain provisions of these Terms may be temporarily or permanently superseded by expressly designated legal notices or terms located on particular pages on this Site or in particular e-newsletters, messages, or RSS feeds from this Service.

A3. AVAILABILITY AND MODIFICATION OF THE SERVICE
We do not guarantee complete and/or uninterrupted access to the Service by the general public at all times. 4T4C shall have no liability for the unavailability of the service, any loss of data or transactions caused by planned or unplanned outages, or any outages of webhosting providers or the Internet providers or the Internet network external to the Site.
4T4C reserves the right at any time and from time to time, in its sole discretion and without notice, (a) to modify, augment, enhance, update, terminate, eliminate, suspend, discontinue (temporarily or permanently), any content, feature or aspect of the Service (or any part thereof); (b) to change the operating conditions for access or use of the Service or any content, feature, part or aspect thereof, such as, without limitation, the periods of availability or the equipment needed for access or use; (c) to change any fees or charges associated with use of the Service or for any services or products offered for sale or otherwise made available in or via the Service. You agree that 4T4C shall not be liable to you or to any third party for any modification, termination, suspension, discontinuance or changed operating conditions of the Service or any of its content, features, parts or aspects. You also agree that, unless explicitly stated otherwise in the modified Service, any modification, augmentation, enhancement or update of any content, feature or aspect of the current Service shall be subject to these Terms of Service.
B1. INTERSTATE COMMUNICATION
By agreeing to these Terms of Service, you acknowledge that because of the interstate nature of Internet networks (a) your use of this Site and this Service within the United States results in interstate data transmissions, (b) your use of this Site and this Service within the United States may result in data transmission over various networks with differing technical requirements which may be subject to change at any time and from time to time.
B2. OBTAINING ACCESS
Gloriscope.com resides on its dedicated IP address that is not shared with other websites. You are responsible for obtaining access to the Service, including, but not limited to: (a) obtaining and maintaining all hardware, software, Internet connections, and other means necessary to access and use the Service; (b) any third-party fees that may be applicable for your obtaining Internet or wireless access to the Service or for display or delivery of advertisements to you by or through the Service. You assume the entire cost of and responsibility for any damage to, and all necessary maintenance, repair or correction of, the hardware and/or software mentioned above in this Section.
You acknowledge that this Site and this Service, and software contained or embodied within them, may include software code or security components that permit digital material to be protected. You agree that you may not attempt to copy, modify, reverse engineer, reverse assemble, otherwise discover, hack, override or circumvent any of such security component(s) in any manner or form, including (without limitation) for the purpose of obtaining unauthorized access to this Site or this Service. You agree not to access this Site or this service by any means other than through the interface provided by 4T4C for use in accessing this Site or this Service.
B3. DENIAL OF ACCESS
4T4C reserves the right to deny, in its sole discretion, access to the Service or any portions or features thereof to any person or entity for any reason, with or without notice, and without any liability. For example (without limitation), this may occur if a User violates the Terms or, in our sole judgment, infringes the rights of others or interferes with the ability of others to enjoy the Site and the Service.
B4. TYPES OF ACCESS AREAS
The Site may be divided into various areas: (a) areas with free-of-charge access to all Users without User registration, (b) areas with free-of-charge access to all Users who have completed User registration, (c) areas with paid access requiring User Registration and either paid membership or paid subscription. Hereafter, areas under (a) will be called “Nonregistration Areas,” areas under (b) will be called “Registration Areas,” areas under (a) and (b) will be called “Free-of-charge Areas,” and areas under (c) will be called “Premium Areas.”
B5. REGISTRATION OF USERS
Certain unpaid and paid areas of the Service are only open to you if you register (“Registration Areas”).or may otherwise require you to provide information to participate in certain features or the Service or access certain content, services, products, software or aspects of the Service. Providing such information is purely optional and voluntary; however, access to the Registration Areas or to certain features, content, services, products, software or aspects of the Service may be denied to you if you do not register beforehand.
When you register, we will open a user account or member account (“Account”) for your personal use. During the registration process, a user ID or member ID (”ID”) and password (“Password”) will be provided to you by us or, in some types of registration, you will be allowed to select an ID and Password yourself. Each registration is for one user or member only, you are not allowed to share your ID and Password with other people, sell, transfer or assign them to other people, or allow other people access to the Service through your ID and/or Password. If you do this, 4T4C may suspend or terminate your access to the Service. If you are given an opportunity to choose an ID yourself, you are not allowed to chose (a) an ID that is already in current use; )b) impersonate someone else; (c) an ID that may create confusion; (d) an ID that is illegal; (e) an ID in which another person or entity has a trademark or other proprietary right without such a person’s or entity’s authorization; (f) an ID which we, in our sole discretion, deem to be vulgar or otherwise offensive; (g) an ID that, in our sole discretion, may be unacceptable for any other reason. If you do not comply with these restrictions, you will be in breach of the Terms and we may immediately terminate your Account.
You agree to be responsible for maintaining the confidentiality of your Password.
We may give Users or Members of the Service an opportunity, if they so wish, to have a user email account (“User Email Account”) linked to your User Account or Member Account. However, no User Email Accounts will be opened to persons under 18 years of age. You may cancel your User Email Account at any time by emailing your cancellation notice to our Customer Care: customer-care(at)gloriscope.com.
If our email messages to your email address (which you have provided during your registration for Gloriscope.com) will be delivered to you via a network operated or owned by a third party, such as your church, employer, college or university, then you warrant that you are entitled to receive those messages on such a network. You also agree that we may refrain from sending you email messages without notifying you, even if you have subscribed to receive them, if we receive a request from a third party to stop sending email messages to you.
You agree to provide to us, during the registration process, only true, accurate, current and complete information about yourself and your email address (“Registration Data”) when prompted by the applicable online registration pages. You should be aware that we will rely on any information you provide on us. These Terms prohibit using a name other than your own legal name, except in certain cases when we specifically ask you to provide a unique, fictitious screen name for online use. It is your responsibility to keep all the registration information true, accurate, complete and promptly updated at all times, which is especially important if you are a Subscriber to any Premium Areas of the Service. Our use of your personally identifiable Registration Data, or other personally identifiable information you may provide, is governed by the terms and conditions of our Privacy Policy Statement, which is an integral part of these Terms. If you provide any Registration Data that are untrue, inaccurate, or not currently complete, we reserve the right, in our discretion, to terminate or suspend your User Account and refuse to you all current and/or future use of the Service or any portion thereof. You agree to be responsible for any loss caused by your failure to provide or keep your Registration Data true, accurate, current and complete.
You agree (a) to log out from your account at the end of each session on your Account; (b) to immediately inform our Customer Care of any known or suspected unauthorized access of use(s) of your Account or Password or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your Password or your credit card information. Any fraudulent, abusive, illegal or improper use or activity, or other use or activity under your ID or Password in breach of the Terms, may in our discretion be grounds to suspend or terminate your Account and we may refer the matter to law enforcement. You may terminate your Account at any time by emailing your cancellation notice to our Customer care: customer-care(at)gloriscope.com.
YOU ARE SOLELY RESPONSIBLE FOR KEEPING YOUR PASSWORD AND USER ID OR MEMBER ID CONFIDENTIAL AND YOU ARE FULLY RESPONSIBLE FOR ALL ACTIVITIES (WHETHER BY YOUR OR OTHERS) THAT OCCUR UNDER YOUR ACCOUNT OR PASSWORD, INCLUDING ANY UNAUTHORIZED OR ILLEGAL USE OR ACTIVITIES IN BREACH WITH THESE TERMS. 4T4C CANNOT AND WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT MAY OCCUR AS A RESULT OF YOUR FAILURE TO COMPLY WITH THIS SECTION OF THE TERMS OR AS A RESULT OF SOMEONE USING YOUR ACCOUNT OR PASSWORD, EITHER WITH OR WITHOUT YOUR KNOWLEDGE.
B6. PRIVACY POLICY
All Registration Data and certain other information that you provide about yourself to the Service will be used in accordance with our Privacy Policy. For more information about our practices with respect to the collection, use, and disclosure of personal information, please see our Privacy Policy Statement.
C1. GLORISCOPE.COM CONTENT
“Gloriscope.com Content” is all content and materials and the derivation, selection, coordination, compilation, arrangement, organization and design of the Gloriscope.com Site or Service (or available via the Service) and of any content or material emailed to you or otherwise made available to you in conjunction with Gloriscope.com. The Gloriscope.com Content may include, without limitation: text, images, photographs, graphics, illustrations, artwork, audio clips, video clips, audio-video clips, RSS feeds, content emailed or otherwise transmitted to Users, computer code, trademarks and service marks, logos, advertising and sponsorship material, the selection, coordination, arrangement, derivation and design (including look and feel) of the Gloriscope.com Site and Service.
Any and all portions, elements and aspects of the Gloriscope.com Content that are owned by 4T4C will hereafter be called “4T4C Content.” 4T4C News Corp. owns the copyright (all rights reserved) in (a) the selection, coordination, arrangement, derivation, design (including look and feel) and/or enhancement of Gloriscope.com Content or of this Service, AND (b) in the content and materials original to 4T4C.
The Gloriscope.com Content not owned by 4T4C, but either in public domain or licensed to 4T4C, will hereinafter be called “Non-4T4C Content.” Such content may be under the control of their respective owners and/or licensors. 4T4C may have licenses or permissions to use Non-4T4C Content on the Gloriscope.com Site and Service.

6. You may occasionally email published headlines and their URL Web addresses (but not full text articles) displayed on or retrieved by you from the Site or Service to up to twenty (20) individuals using our email function for your personal noncommercial use, but you may not use the email function for the purpose of regularly providing other people with access to Gloriscope.com Content or this Service.
7. You may make a summary (of up to 50 words) of an article on Gloriscope.com and publish it on your website or in your blog or e-newsletter, under the condition that you (a) publish your summary together with the article’s original headline, and (b) hyperlink the article’s original headline directly to the full article on Gloriscope.com.
8. You may establish a hyperlink (but not a hotlink) to the Site or to specific Gloriscope.com Content in accordance with the provisions in Section D2 below.
9. You may use spidering technology to search and link to Gloriscope.com, provided you do not infringe the restriction on use (see Section C4 and Section C8 below).
10. You may directly quote from any article on the Site and post such a quote on a non-4T4C or non-Gloriscope website, blog, newsgroup, discussion group, mailing list or discussion board, provided that you (a) link back to the full article on Gloriscope.com, and (b) directly quote the text as it appears on Gloriscope.com. Generally speaking, a single, unbroken, directly-quoted text of up to fifty (50) words republished in a context that does not distort the original meaning of the quoted text is permissible in most cases. However, it is not permitted to make a selective quote (by quoting portions of text or combining words and sentences in a new way) in a manner that changes the meaning of the quoted text, or to use the quoted text out of its original context. If the length and/or number of the quote(s) from the same article is too large, or if the context in which the quoted text is to be republished may not be appropriate, you may need our special written permission to make and publish such quotes.
11. Use by churches, study groups, or for educational or research purposes. You have our free-of-charge permission to make paper reprints of individual articles of 4T4C Content on Gloriscope.com under the following terms and conditions:
a) The reprints must be made for noncommercial study use (for example in church groups, Christian camps or other Christian ministries), for classroom use by educators, or for academic research not meant for publication.
b) Not more than two hundred (200) reprints of the same content may be made.
c) All reprints must be distributed to users free of charge.
d) If the reprints are made from the content available in our Premium Areas, you must pay the subscription or other applicable fee to access that Premium Area.
e) The following credit line must appear on each manufactured copy of the reprints: “The source of this copyrighted content is www.Gloriscope.com. Used with permission. ”
All use of the Gloriscope.com Content not specifically permitted above is expressly prohibited without a special prior written permission by 4T4C or its licensors.
4T4C reserves the right to revise, delete portions of, revoke or terminate this Limited License at any time and from time to time. If the Terms are revised, we will publish a revised version of this Limited License in a revised version of these Terms of Service, posted on Gloriscope.com, indicating the date of the latest revision. A revised version of this Limited License shall be effective immediately when posted on the Gloriscope.com Site. By continuing to use this Site or Service, you agree to be bound by the revisions of this Limited License and of these Terms of Service. You agree to review the Terms periodically to be aware of such revisions.

Without a prior written permission from 4T4C or other respective copyright owner, you are not permitted (without limitation): to post or repost on the World Wide Web, use, publish, reproduce, copy, publicly perform, publicly display, digitally perform, broadcast, rewrite for broadcast, make, sell, offer for sale, rent, lease, transfer, rent, lease, transfer, exchange, barter, exploit, fully sublicense (through multiple tiers), translate, excerpt, extensively quote, modify, adapt, transmit, download, store, archive, distribute, disseminate, create mash-ups of, create derivative works of, incorporate in other works, host, index, transform into a digitally searchable format, enter into database, cache, tag, or encode any Gloriscope.com Content or any part of this Service, in whole or in part, under copyright, trademark, service mark or patent laws under any relevant jurisdiction, for any purpose whatsoever, commercial or otherwise, in any manner, form or medium now known or hereafter developed. You agree that the term “adapt” in the foregoing sentence includes, without limitation, the right to adapt to streaming, downloading, broadcasting, scanning, adapting for mobile, digital or other technologies now known or hereafter to be developed.
Specific prohibited uses of Gloriscope.com Content include, but are not limited to, the following:

2. - You may not distribute over any network (including a local area network or LAN) any Gloriscope.com Content.
3. - You may not sell or offer for sale any Gloriscope.com Content.
4. - You may not rearrange, recompile or modify any Gloriscope.com Content.
5. - You may not edit, condense or adapt any Gloriscope,.com Content, including adaptation for broadcasting, without prior written permission.
6. - You may not make excerpts of articles, except with prior written permission and without changing the intended meaning of the original text.
7. - You may not index or enter into a database any Gloriscope.com Content.
8. - You may not create a wiki, encyclopedia, handbook or any other structured survey or manual of the Gloriscope.com Content or any part of this Service by systematically and/or regularly or frequently downloading, caching, spidering, printing and/or storing all or any of the Gloriscope.com Content.

16. - The information in any directories of organizations, institutions, activities, persons, topics, geographical or administrative areas or other categories that may be provided on the Site or in this Service is provided for lookup purposes only and is not be used for marketing, telemarketing, promotional, public relations, or political applications.
17. - Unauthorized commercial use of any Gloriscope.com Content or any part of this Service is strictly prohibited. Examples of commercial use include, but are not limited to,
(a) offering any of our Gloriscope.com Content or any part of this Service for sale or charging direct or indirect fees for such Content, or
(b) incorporating such Content in a book, a compendium or an e-newsletter which is offered for sale or by paid-for subscription, or

12. 4T4C discourages you (the User) from divulging, in Interactive Areas, their personal addresses, phone numbers, social security numbers, bank account numbers, place of work or other personal information that can be used to identify or locate you.
13. By submitting Interactive Content, you agree to indemnify 4T4C and/or its affiliates, subsidiaries and each of their respective partners, officers, directors, employees and agents against, and to hold each of them harmless from, any and all claims, liabilities, costs and expenses (including legal expenses) that may arise from of any Interactive Content posted, uploaded, emailed, transmitted or otherwise made available by you to the Service and published, distributed, transmitted or otherwise used by the Service
4. You understand and acknowledge that the Interactive Areas contain content provided by non-4T4C authors and providers over whom 4T4C has no control. You agree that 4T4C shall under no circumstances be liable in any way for any Interactive Content, including, but not limited to, any errors, inaccuracies, omissions or other defects or deficiencies in any Interactive Content, or any loss or damage of any kind incurred as a result of the use of any Interactive Content posted, uploaded, emailed, transmitted or otherwise made available via the Service.

You waive any moral or other rights you may have in having your Interactive Content deleted, edited, moved, modified, published, transmitted or displayed in any way that may not be agreeable to you.
7. You agree that 4T4C has the right, but not the obligation, in its sole discretion and without notice to edit your Interactive Content for length, clarity, grammar, spelling, style or decency. 4T4C shall in no way be liable for any editing of your Interactive Content.
8. You agree that none of your Interactive Content shall be subject to any obligation of confidentiality, attribution or otherwise, on 4T4C’s part, nor shall 4T4C be liable for any use or disclosure of any Submitted Content.
9. You agree that 4T4C has the right, in its sole discretion and without notice, to limit, suspend or terminate your access or use of the Interactive Areas or any portion thereof. If 4T4C chooses to do so with regard to you, you agree to waive any moral rights that you may have in regard to your Interactive Content.
E5. RULES OF CONDUCT IN INTERACTIVE AREAS
All of the rules in this Section E5 apply to all Interactive Areas of Gloriscope.com, including Letters to the Editor. By sending us a Letter to the Editor or using any Interactive Areas on this Site or in/via this Service, you agree to abide by the following rules and conditions of conduct in Interactive Areas (“Rules of Conduct”):

11. You may not, without our prior written or email permission, make multiple postings, multiple uploads or multiple transmissions of the same Interactive Content under multiple threads, subjects, or Interactive Areas of the Service. (Note: “Multiple” means two or more.)
12. You may not post, upload, email, transmit or otherwise make available any Interactive Content or links to material that is misleading, deceptive, fraudulent, inaccurate, unfair, contains gross exaggeration or unsubstantiated claims, libelous, defamatory, disparaging, insulting, profane, obscene, indecent, lewd, pornographic, harmful, tortious, violent, abusive, grossly inflammatory, inflaming hatred, threatening, harassing, invasive of another’s privacy, contains any actionable statement, or tends to mislead on any other person, business or entity.

E6. YOUR CONTENT SUBMITTED FOR OUR PUBLICATION

IN NO EVENT WILL 4T4C, ITS OFFICERS, DIRECTORS, CORPORATE MEMBERS, SUBSIDIARIES, AFFILIATES, DISTRIBUTORS, LICENSORS, AGENTS, SUPPLIERS OR OTHERS INVOLVED IN CREATING, OPERATING, SPONSORING, PROMOTING, OR OTHERWISE MAKING AVAILABLE THIS SERVICE AND ITS CONTENTS, SERVICES, PRODUCTS AND SOFTWARE BE LIABLE TO ANY PERSON OR ENTITY WHATSOEVER FOR ANY CLAIMS, LOSSES, OR DAMAGES WHATSOEVER, INCLUDED, BUT NOT LIMITED TO, (A) LOSS OF PROFITS, REVENUE, OR OTHER PECUNIARY LOSS, INTERRUPTION, LOSS OF GOODWILL, LOSS OF DATA OR INFORMATION OR OTHER INTANGIBLE LOSSES; (B) YOUR INABILITY TO USE, UNAUTHORIZED USE OF, PERFORMANCE OR NON-PERFORMANCE OF THE GLORISCOPE.COM SITE AND THIS SERVICE; (C) UNAUTHORIZED ACCESS TO OR TAMPERING WITH YOUR PERSONAL INFORMATION OR TRANSMISSIONS; (D) THE PROVISION OR FAILURE TO PROVIDE ANY SERVICE; (E) ERRORS, INACCURACIES, AND OTHER DEFECTS CONTAINED IN THE GLORISCOPE.COM SITE OR ANY INFORMATION, SERVICES, PRODUCTS, SOFTWARE, AND RELATED VISUAL OR AUDIO CONTENT OBTAINED THROUGH THE GLORISCOPE.COM SITE; (F) ANY TRANSACTIONS ENTERED INTO THROUGH THE GLORISCOPE.COM SITE; (G) ANY PROPERTY DAMAGE, INCLUDING, BUT NOT LIMITED TO, DAMAGES TO YOUR COMPUTER, COMPUTER SYSTEM, LOCAL NETWORK OR MOBILE DEVICES CAUSED BY SOFTWARE VIRUSES OR OTHER HARMFUL COMPONENTS, DURING OR ON ACCOUNT OF ACCESS TO OR USE OF THE GLORISCOPE.COM SITE OR ANY OTHER SITE TO WHICH IT PROVIDES HYPERLINKS; OR (H) ANY OTHER DAMAGES WHATSOEVER ARISING DIRECTLY OR INDIRECTLY FROM THE USE OF, OR FAILURE TO USE, OR RELIANCE ON GLORISCOPE.COM OR THIS SERVICE,. THE LIMITATIONS OF LIABILITY SHALL APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER BASED ON NEGLIGENCE, TORT, CONTRACT, STRICT LIABILITY, OR OTHER THEORY OF LIABILITY, EVEN IF 4T4C HAS BEEN ADVISED OF THE POSSIBILITY THAT SUCH DAMAGES MAY ARISE. YOU ALSO SPECIFICALLY ACKNOWLEDGE AND AGREE THAT 4T4C AND ITS OFFICERS, DIRECTORS, CORPORATE MEMBERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY USER. IF ANY APPLICABLE AUTHORITY HOLDS ANY PORTION OF THIS SECTION TO BE UNENFORCEABLE UNDER THE LAWS APPLICABLE TO THIS AGREEMENT, THEN THE LIABILITY OF 4T4C AND ITS PARTIES WILL BE LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY APPLICABLE LAW.
THE SERVICE MAY OFFER FEATURED CONTENT, SERVICES, PRODUCTS OR SOFTWARE FROM CERTAIN SELECTED THIRD-PARTY PROVIDERS WITH WHOM 4T4C MAY HAVE A BUSINESS RELATIONSHIP OR A CHRISTIAN MINISTRY RELATIONSHIP. THE LIMITATION OF LIABILITY IN THIS SECTION SHALL APPLY ALSO TO SUCH PROVIDERS AND THEIR OFFERINGS AND 4T4C SHALL NOT BE RESPONSIBLE FOR THEIR CONTENTS, SERVICES, PRODUCTS AND SOFTWARE AVAILABLE ON OR VIA THE SERVICE.
G6. INDEMNITY
YOU AGREE TO INDEMNIFY, DEFEND, COOPERATE TO THE REASONABLE EXTENT IN THE DEFENSE OF, AND HOLD HARMLESS 4T4C NEWS CORP., ITS OFFICERS, DIRECTORS, CORPORATE MEMBERS, EMPLOYEES, INTERNS, VOLUNTEERS, REPRESENTATIVES, CONTRACTORS, AGENTS, AFFILIATED COMPANIES, SUBSIDIARIES, PARTNERS, SUPPLIERS AND LICENSORS FROM ANY AND ALL CLAIMS (INCLUDING, BUT NOT LIMITED TO, CLAIMS FOR DEFAMATION, TRADE DISPARAGEMENT, PRIVACY AND INTELLECTUAL PROPERTY INFRINGEMENT), DAMAGES, LOSSES, EXPENSES AND COSTS (INCLUDING ATTORNEYS’ FEES AND COURT COSTS) RESULTING DIRECTLY OR INDIRECTLY FROM, OR RELATING TO, ANY ALLEGATION REGARDING: (A) YOUR USE OF GLORISCOPE.COM; (B) ANY VIOLATION BY YOU OF THESE TERMS OF SERVICE; (C) OUR USE OF ANY CONTENT OR INFORMATION YOU PROVIDE, AS LONG AS OUR USE IS NOT INCONSISTENT WITH THIS AGREEMENT; (D) INFORMATION OR MATERIAL POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH YOUR MEMBERSHIP OR SUBSCRIPTION ACCOUNT, EVEN IF NOT POSTED, TRANSMITTED OR OTHERWISE MADE AVAILABLE BY YOU. (E) YOUR VIOLATION OF THE COPYRIGHT, TRADE SECRET, TRADEMARK OR ANY OTHER PROPERTY RIGHTS OF A THIRD PARTY.
H1. ENTIRE AGREEMENT
These Terms of Service, which include the Privacy Policy Statement for Gloriscope.com as its integral part, constitute the entire Agreement between you and 4T4C and govern your use of the Service, superseding any previous and contemporaneous agreements, proposals, documents, correspondence, conversations or other oral or written communications with respect to your use of the Service.
H2. GOVERNING LAW AND JURISDICTION
You agree that any claim, action, or proceeding arising out of the Terms, or your use of Gloriscope.com and this service, shall be governed by and construed in accordance with the laws of the State of Minnesota (applicable to contracts to be wholly performed therein) without regard to its conflict of law provisions. You hereby agree that any cause of action you may have with respect to 4T4C News Corp. must be filed in a federal or state court located in Minneapolis or St. Paul, Minnesota. In addition, you agree to submit to the personal jurisdiction of such courts.
H3. NOTICES TO 4T4C
Legal notices to 4T4C News Corp. must be given in writing by letter and mailed to: 4T4C News Corp., Attn: Legal Counsel, P.O. Box 6226, Minneapolis, MN 55406-0226.
H4. STATUTE OF LIMITATION
You agree that, regardless of any statute or law to the contrary, any claim or cause of action you may have with respect to the Terms or your use of this Service must be filed within two (2) months of the time in which the events giving rise to such claim began, or you agree to waive such claim or action.
H5. EXCLUSIONS AND LIMITATIONS
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN WARRANTIES AND CONDITIONS, AND/OR THE DISCLAIMER OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. ACCORDINGLY, SOME OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU.
H6. WAIVER AND SEVERABILITY OF TERMS
No delay or omission on the part of either party to this Agreement to exercise or enforce any right, provision or remedy under the Terms does not constitute a waiver of that right, provision or remedy.
If any provision of the Terms is found to be unlawful, void or unenforceable by any court having competent jurisdiction, then that provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of the remaining provisions of the Terms, which shall remain in full force and effect.
H7. NON-TRANSFERABILITY
You agree that these Terms are personal to you and that your rights and obligations under the Terms may not be assigned, sub-licensed or otherwise transferred to anyone. You agree that your Account and User ID for this Service, as well as the contents within such Account, terminates upon your death. Upon receipt of a copy of a death certificate, your Account may be terminated and all contents therein permanently deleted. However, this Agreement for the use of the Service may be assigned to a third party by 4T4C.
H8. TRANSFER OF THIS AGREEMENT
4T4C News Corp. may at any time transfer its rights and obligations under this Agreement to any affiliate, subsidiary or business unit, or any of their affiliated companies or divisions, or any entity that 4T4C News Corp. acquires.
H9. TERMINATION
This Agreement shall remain effective until terminated in accordance with its own terms (i.e. these Terms of Service). The Agreement may be terminated by either party at any time. 4T4C reserves the right, in its sole discretion, to immediately terminate this Agreement with respect to any User, with or without notice. Cause for such termination shall include, but not be limited to, (a) breaches, violations, or assignment of these Terms or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated Account deletions), (d) discontinuance or material modification to the Service (or any part thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, (g) engagement by you in fraudulent, illegal, or indecent activities, and/or (h) nonpayment of any fees owed by you in connection with the Services. Termination of your Account includes (a) removal of access to all offerings within the Service, (b) deletion of your password and all related information, files and content associated with or inside your Account (or any part thereof), and (c) barring of further use of the Service. Further, you agree that all terminations for cause shall be made in 4T4C’s sole discretion and that 4T4C shall not be liable to you or any third party for any termination of your Account, any associated email address, or access to the Service or for deletion of your information, files and content associated with or inside your Account (or any part thereof).
In the event of termination of this Agreement for any reason, you agree that the following provisions will survive: the provisions of the Privacy Policy Statement, the provisions regarding our denial, restrictions or limitations on your use of the Service, any Content License(s) and other licenses or permissions you may have granted to 4T4C, and all other provisions of these Terms for which survival is equitable or appropriate.
H10. HEADINGS
Headings in these Terms are for convenience only and have no legal meaning or effect.
